Terms of Service

These Terms of Service ("Terms") govern your use of louisianasodfarms.com and any sod or related services purchased from Louisiana Sod Farms (operated by PME LLC, hereafter "we," "us," or "our"). By using this website, requesting a quote, or placing an order, you agree to these Terms.

1. Services

Louisiana Sod Farms supplies fresh-cut warm-season sod (St. Augustine, Zoysia, Bermuda, Centipede, Bahia, and Carpetgrass cultivars) for delivery throughout Louisiana. We coordinate delivery from a network of Louisiana sod farms. Installation services are available through our partner network in select areas.

2. Quotes and Pricing

All quotes are estimates based on the information you provide (variety, square footage, delivery zip code, and project specifics). Final pricing is confirmed at the time of order. Prices may vary based on:

• Variety availability and seasonal supply
• Delivery distance and zip code
• Order volume (contractor discounts apply at five or more pallets)
• Fuel surcharges during periods of significant fuel price changes
• Same-day or expedited delivery requests

Quotes are typically valid for 14 days unless stated otherwise.

3. Orders and Payment

Orders are confirmed when you authorize delivery in writing (email, text, or signed quote) and provide payment per the agreed terms. We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, American Express, Discover)
• Bank transfer (ACH)
• Check (cleared funds required before delivery)
• NET 30 terms for qualified contractor and builder accounts (subject to credit approval)

For non-NET-30 accounts, payment is due in full before pallet release from the farm. For NET 30 accounts, payment is due within 30 days of invoice. Past-due accounts may be subject to late fees and credit holds.

4. Delivery

Delivery windows are scheduled at the time of order. Same-week delivery is typical for most Louisiana zip codes when ordered before noon. Same-day delivery is possible on early-morning calls when the variety is in season. Delivery times are estimates, not guarantees.

Customer responsibilities for delivery:

• Provide accurate delivery address and contact phone number
• Identify a clear, accessible drop location for pallets (driveway, designated parking area, or curb)
• Be available or provide contact for any access questions during delivery
• Inspect pallet count and obvious quality at the time of delivery
• Install or schedule installation within 24 hours of delivery to prevent quality decline

Delays caused by weather, traffic, force majeure, or customer-caused access issues are not our liability. Re-delivery fees may apply if you are not available at the agreed window or the drop location is inaccessible.

5. Sod Quality and Warranty

We guarantee that sod arrives fresh-cut from the farm on the day of delivery, free of major weed contamination, and in good condition for installation. Quality claims must be made within 24 hours of delivery, before installation, and supported by photographs.

What our quality guarantee covers:

• Fresh-cut sod (cut the same day, not from storage)
• Substantially correct variety as ordered
• Substantially correct pallet count
• No visible major disease or pest contamination at delivery

What our quality guarantee does NOT cover:

• Failure to root due to improper watering, prep, or installation
• Damage from weather events (freeze, drought, flooding, hail) after delivery
• Pest, disease, or weed pressure that develops after installation
• Cosmetic blade variation that is normal for fresh-cut sod
• Color variation due to recent cutting (will green up within 7-14 days)
• Sod left on pallet for more than 24 hours after delivery

Approved quality claims may result in partial credit, replacement pallets at no charge, or refund at our discretion based on the nature of the issue.

6. Returns and Refunds

Sod is a perishable agricultural product. We do not accept returns of cut sod. Refunds may be issued only in the case of an approved quality claim per Section 5. Order cancellations require at least 24 hours notice before scheduled cutting; later cancellations may incur a 25 percent restocking fee.

7. Installation Services

If you elect installation services through our partner network, the installation contractor is an independent business operating under separate terms. We coordinate the installation but do not directly perform installation work. Installation warranty terms are provided by the installing contractor at the time of service.

8. Limitation of Liability

To the maximum extent permitted by Louisiana law, our total liability for any claim related to a sod order is limited to the purchase price paid for the order. We are not liable for indirect, consequential, or incidental damages including but not limited to loss of property value, landscape design fees, irrigation costs, or labor for re-installation.

9. SMS and Phone Communication (TCPA Consent)

By providing your phone number to Louisiana Sod Farms, you expressly consent to receive calls and text messages regarding your inquiry, quote, order, delivery, and follow-up. Standard message and data rates may apply. Message frequency varies. Reply STOP to opt out of texts at any time. Reply HELP for assistance. 10. Website Use

You agree not to:

• Use this website for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or republish content without written permission
• Submit false information through forms
• Use automated tools to submit forms or place fake orders

11. Intellectual Property

All content on louisianasodfarms.com (text, images, logos, design, and code) is the property of PME LLC and is protected by copyright. You may not reproduce, distribute, or create derivative works without express written permission.

12. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Any dispute arising from these Terms or any order placed with Louisiana Sod Farms shall be resolved in the state or federal courts located in Louisiana.

13. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of the website or placement of new orders after a Terms update constitutes acceptance of the revised Terms.
